Terms of Service

These Terms of Service ("Terms") form a binding agreement between Jussive LLC, a South Carolina limited liability company ("Jussive," "we," "us," "our"), and you. By creating an account, installing the Jussive mobile application, accessing the web dashboard, or using any Jussive service (collectively, the "Services"), you agree to these Terms, the Privacy Policy, the Acceptable Use Policy, and the EULA. If you do not agree, do not use the Services. You must be at least eighteen (18) years old and legally capable of entering into a binding contract.

1. Definitions

  • "Account Holder" or "Subscriber": the individual or entity that registers for and pays for the Services.
  • "Monitored Device": any device on which the App is installed and enrolled under an Account.
  • "Monitored User": the person using a Monitored Device.
  • "Content": data processed through the Services, including location data, telemetry, device contacts, and account information.
  • "Enhanced Plans": paid tiers beyond the Basic Subscription that may be released in the future.

2. The Services

Jussive offers software-as-a-service for device activity monitoring, primarily for parental and household oversight. Currently, Jussive only support offering services to Apple devices and is planning to support Andriod mobile devices in the future.

2.1 Basic Subscription Includes

  • Location capture (visited places, trip routes, last reported location, raw GPS points), subject to device capability and consent;
  • Interactive mapping and visualization;
  • Trip playback with telemetry (e.g., speed and heading) where supported;
  • Storage of up to 1,000 device contacts per Monitored Device, where supported;
  • Rolling seven (7) day retention or plan allowance of location and trip data;
  • Retention of device contacts while the subscription is active.

2.2 Enhanced Plans

Features beyond the Basic Subscription are in development. Availability, features, pricing, and timelines are not guaranteed.

2.3 Service Changes

We may add, modify, suspend, or discontinue any aspect of the Services at any time.

2.4 Data Retention

In an effort to prevent data loss we will retain all device data for a period of at least 12 hours when a device is unenrolled. Device data will be restored upon enrolling the device again within threshold.

3. Accounts

3.1 Registration

You must provide accurate, current, and complete information and keep it updated.

3.2 Account Security

You are responsible for safeguarding credentials and all activity under your Account. Notify us immediately of unauthorized use.

3.3 One Account Per Person

You may not create multiple Accounts, share credentials, or transfer your Account without authorization.

4. Subscriptions, Billing, and Cancellation

4.1 Recurring Subscriptions

Paid plans auto-renew at the then-current rate at the end of each billing period until canceled.

4.2 Payment

Payments are processed by third parties (e.g., Stripe, Apple, Google). Their terms govern processing. You authorize recurring charges.

4.3 App Store / Google Play

Subscriptions made through Apple or Google are governed by their terms; manage them through your Apple ID or Google account.

4.4 Cancellation

Cancel via the payment provider which can be accessed through the Jussive billing portal or the applicable app store. Cancellation takes effect at the end of the billing period. Fees are non-refundable and no pro-rata refunds are issued for partial periods except where required by law.

4.5 Price Changes

We will provide at least 30 days' notice of material price changes, effective at your next renewal.

4.6 Failed Payments

We may suspend or terminate Services on payment failure and retry the charge.

4.7 Taxes

You are responsible for all applicable taxes other than those based on Jussive's net income.

4.8 Promotions

Promotions are subject to the terms and conditions offered, and when the promotiion period is over a subscription automatically converts to the advertised rate.

4.9 Refund Policy

All subscriptions are elegible for a refund if unasatisified for any reason within 7 days of starting the subscription. All other refunds are subject to approval and may not be offered outside of the terms aforementioned.

5. Consent, Monitoring, and Lawful Use

5.1 Consent Is Required

Services are designed for monitoring with the informed, ongoing, and revocable consent of the Monitored User (or, for a minor, the legal guardian).

5.2 Revocable Consent

Monitored Users may revoke consent, change device settings, or uninstall the App at any time. The Basic Subscription does not prevent uninstallation of the App.

5.3 Your Representations

You represent and warrant that:

  • You have legal authority to enroll each Monitored Device;
  • You have obtained all required consents under applicable law (wiretapping, privacy, COPPA, GDPR, state law, etc.);
  • You will provide clear notice to Monitored Users as required by law;
  • You will not use the Services for stalking, harassment, intimate partner surveillance, unauthorized employee surveillance, or unlawful purposes;
  • You will comply with the Acceptable Use Policy and applicable law.

5.4 Prohibited Use on Adults Without Consent

Covert monitoring of adults without informed consent is strictly prohibited and may result in immediate termination and cooperation with law enforcement.

6. License Grant

Subject to your compliance with these Terms, Jussive grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for personal or internal household use during the subscription term. All other rights reserved.

7. Acceptable Use

Your use is governed by the Acceptable Use Policy, incorporated by reference. Violations may result in immediate suspension or termination without refund.

8. Intellectual Property

8.1 Jussive IP

The Services, App, software, designs, logos, and trademarks are owned by Jussive or its licensors.

8.2 Your Content

You retain ownership of Content you submit and grant Jussive a worldwide, non-exclusive, royalty-free license to host, process, and display such Content solely to operate and improve the Services.

8.3 Feedback

Feedback or suggestions you provide may be used by Jussive without restriction or compensation.

9. Third-Party Services

The Services integrate with third parties (OS providers, mapping providers, carriers, payment processors, cloud infrastructure). Jussive is not responsible for their acts, omissions, availability, or data practices.

10. Electronic Communications

All agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

10.1 Service Communications

Notices about your account (e.g., password changes, security alerts), updates to these Terms, our Privacy Policy, and other administrative or transactional messages. These are considered part of the Service, and you may not be able to opt out of receiving them as long as you maintain an active account.

10.2 Marketing Communications

By registering an account, users consent to being added to mailing lists for advertising and promotional purposes. You may opt out of marketing communications at any time by following the "Unsubscribe" link included in such emails or by emailing support@jussive.com

11. Service Disclaimer (Embedded)

11.1 "As Is" and "As Available"

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. JUSSIVE DISCLAIMS ALL WARRANTIES INCLUDING:

  • Accuracy, completeness, timeliness, or reliability of telemetry, location, or contact data;
  • Uninterrupted, secure, or error-free operation;
  • Compatibility with any device, OS, carrier, or third-party service;
  • Resistance to tampering, jailbreaking, rooting, sideloading, or circumvention;
  • Prevention of unauthorized access, malware, spoofing, or interception;
  • Merchantability, fitness for a particular purpose, title, and non-infringement;
  • Any specific outcome, including detection of loss, theft, or emergencies.

11.2 Not an Emergency Service

THE SERVICES ARE NOT AN EMERGENCY RESPONSE OR LIFE-SAFETY SERVICE. Do not rely on them for emergencies or time-critical decisions.

11.3 Beta Features

Beta or preview features are provided without warranty and may be modified or removed at any time.

12. Limitation of Liability

12.1 Excluded Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSSIVE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, REPUTATIONAL HARM, OR EMOTIONAL DISTRESS.

12.2 Liability Cap

JUSSIVE'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

12.3 Basis of the Bargain

These limitations are essential to the bargain. Jussive would not provide the Services without them.

13. Indemnification

You agree to defend, indemnify, and hold harmless Jussive and its affiliates from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the Services;
  • Your violation of the Agreements or law;
  • Your failure to obtain required consents;
  • Your infringement of any third-party right;
  • Content or data you submit.

14. Suspension and Termination

14.1 By You

You may terminate at any time by canceling and discontinuing use.

14.2 By Us

We may suspend or terminate at any time for any reason, including suspected violations, unlawful use, or non-payment.

14.3 Effect

Upon termination, your license ends, access is revoked, Content may be deleted, and unpaid fees become due. Surviving sections continue to apply.

15. Dispute Resolution; Arbitration; Class Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

15.1 Informal Resolution

Contact support@jussive.com before filing a claim. Parties will negotiate in good faith for 30 days.

15.2 Binding Arbitration

Unresolved disputes shall be resolved by binding individual arbitration administered by AAA in Berkeley County, SC.

15.3 Class Action Waiver

You and Jussive agree to bring claims only individually, not as a plaintiff or class member. No consolidation.

15.4 Opt-Out

You may opt out by written notice to support@jussive.com within 30 days of first accepting these Terms.

15.5 Exceptions

Small-claims court and IP injunctive relief are available in a court of competent jurisdiction.

16. Governing Law and Venue

These Terms are governed by the laws of South Carolina. Subject to arbitration, courts in Berkeley County, SC have exclusive jurisdiction.

17. Export and Sanctions

You represent you are not located in or a national of a U.S.-embargoed country and are not on any sanctions list.

18. Force Majeure

Jussive is not liable for failures caused by circumstances beyond reasonable control, including natural disasters, war, labor disputes, internet/utility failures, pandemics, or government actions.

19. Changes

We may update these Terms at any time. Material changes will be communicated via App, email, or website. Continued use constitutes acceptance.

20. Use of Artifical Intelligence in Support Services

20.1 AI-Assisted Support

Jussive may use third-party artificial intelligence ("AI") services to assist in responding to, triaging, summarizing, or resolving customer support requests. These AI services are currently provided through Google Workspace (including Gemini-based features) and Amazon Bedrock, and may include additional AI providers in the future.

20.2 Data Processing by AI Services

By submitting a support request, you acknowledge and agree that the contents of your communication—including any personal information, account details, or other data you provide—may be transmitted to and processed by these third-party AI services for the purpose of providing support. Jussive's use of these AI services is subject to the data processing and privacy terms of the respective providers.

20.3 Support Requests Involving Minors

Because the Services are designed for parental and household oversight, support requests may contain information relating to Monitored Users who are minors (individuals under the age of 18). By submitting a support request that includes information about a minor, you acknowledge that such information may be processed by the AI services described in Section 20.1 as part of the support workflow. Jussive takes reasonable measures to limit the processing of minor data to what is necessary to resolve the support request and requires that its AI service providers maintain appropriate safeguards. You represent that you have the legal authority (e.g., as a parent or legal guardian) to authorize the processing of any minor's information included in your support communications.

20.4 Limitations

AI-generated responses are provided for informational and support purposes only and may not always be accurate or complete. Jussive personnel may review AI-assisted responses before or after delivery. Jussive is not liable for errors or omissions in AI-generated content, subject to the limitations set forth in Section 12.

21. Miscellaneous

  • Entire Agreement: The Agreements constitute the entire agreement.
  • Severability: Unenforceable provisions are severed; the rest remains in effect.
  • No Waiver: Failure to enforce is not waiver.
  • Assignment: You may not assign. Jussive may assign freely.
  • No Third-Party Beneficiaries: Except as stated.

  • Relationship: Independent contractors; no partnership.

Privacy Policy

This Privacy Policy explains how Jussive LLC collects, uses, discloses, and protects personal information when you use our Services. Capitalized terms not defined here have the meanings in the Terms of Service.

1. Scope

This Policy applies to Subscribers (account holders), Monitored Users (users of enrolled devices), and website visitors.

2. Information We Collect

2.1 Information You Provide

  • Account information (name, email, password, payment token identifier);
  • Billing information (processed by our payment processor; we do not store full card numbers);
  • Communications with us (support tickets, emails).

2.2 Information From Monitored Devices

With consent granted on the device, the App collects:

  • Location data (GPS coordinates, visited places, trip routes, timestamps);
  • Telemetry (speed, where supported);
  • Device contacts (name, phone, email; up to 1,000 per device on Basic);
  • Device metadata (model, OS version, app version, enrollment identifiers);
  • Diagnostic data (crash logs, performance).

2.3 Automatically Collected

  • Log data (IP address, browser type, access times);
  • Cookies and similar technologies on our website.

2.4 We Do Not Collect

Without your affirmative action or consent, we do not intentionally collect messages, call content, photos, keystrokes, passwords, or browsing history of Monitored Users.

3. How We Use Information

  • Provide, operate, and maintain the Services;
  • Process payments and manage subscriptions;
  • Communicate with you (transactional, service, support, and marketing);
  • Improve, troubleshoot, and secure the Services;
  • Detect, prevent, and respond to fraud, abuse, or AUP violations;
  • Comply with legal obligations and enforce the Agreements.

We do not sell personal information. We do not use sensitive personal information for targeted advertising.

4. Sensitive Personal Information

Jussive recognizes that location information is among the most sensitive categories of personal information and warrants heightened protection. This section describes the sensitive personal information we collect, how we use it, and the controls we apply to protect it.

4.1 What Qualifies as Sensitive

The following categories of information we collect are classified as "sensitive personal information" under the California Privacy Rights Act ("CPRA"), "sensitive data" under the Colorado, Connecticut, Virginia, Texas, Oregon, Montana, and other U.S. state privacy laws, or otherwise warrant heightened protection:

  • Precise geolocation data — GPS coordinates, visited places, trip routes, and any other location information accurate to within a radius of approximately 1,850 feet (560 meters);
  • Device contact lists — names, phone numbers, and email addresses stored on a monitored device;
  • Account credentials — username/email and hashed password (we never store passwords in plaintext);
  • Information about minors — any information associated with a device used by a child under the age of digital consent in the applicable jurisdiction.

4.2 Purposes for Which We Process Sensitive Personal Information

We process sensitive personal information solely for the following purposes, each of which is consistent with the purposes permitted without additional consumer consent under CPRA § 1798.121(a):

  • Providing the monitoring services that the account holder has signed up for and that the monitored user has consented to on-device;
  • Performing the services on behalf of the account holder — displaying location, trip, and contact information through the Jussive application and dashboard;
  • Detecting security incidents, protecting against malicious activity, and ensuring the integrity of the Services;
  • Short-term, transient use for operational purposes such as caching and request routing;
  • Verifying or maintaining the quality and reliability of the Services;
  • Complying with legal obligations.

We do not use sensitive personal information to infer characteristics about any individual, for advertising of any kind, for profiling, or for any purpose not directly necessary to provide the Services.

4.3 No Sale or Sharing of Sensitive Personal Information

We do not sell sensitive personal information. We do not share sensitive personal information for cross-context behavioral advertising. We do not disclose sensitive personal information to third parties except as described in Section 6 (How We Share Information) and solely to the extent necessary to provide the Services.

4.4 Your Right to Limit the Use of Sensitive Personal Information

Residents of California and certain other jurisdictions have the right to direct Jussive to limit the use and disclosure of their sensitive personal information to purposes necessary to perform the Services. You may exercise this right by:

  • Submitting a request to support@jussive.com;

Because precise geolocation data is essential to the core functionality of the Services, limiting its use may result in the Services being unable to function as intended. If you wish to stop all collection and processing of sensitive personal information, you may cancel your subscription and uninstall the Jussive application at any time.

4.5 Safeguards for Sensitive Personal Information

Jussive maintains administrative, technical, and physical safeguards designed to protect sensitive personal information, including:

  • Encryption of sensitive personal information in transit using TLS 1.2 or higher and at rest using AES-256 or equivalent;
  • Segregation of production environments containing sensitive personal information from development and testing environments;
  • Enforcement of data retention limits, including the rolling seven-day retention period for location data on the Basic Subscription or subscriptions retention allowance;
  • Data protection impact assessments;
  • Incident response procedures providing for notification of affected individuals and regulators within the timeframes required by applicable law.

4.6 Retention of Sensitive Personal Information

Sensitive personal information is retained only for as long as necessary to fulfill the purposes described in Section 4.2:

  • Precise geolocation data (location points, trip routes, visited places): rolling seven (7) days on the Basic Subscription or up to the subscription allowance;
  • Device contact information: for the duration of the active subscription;
  • Account credentials: for the duration of the account plus a reasonable period thereafter;
  • Audit logs and security records

Backups containing sensitive personal information are subject to a retention schedule consistent with primary-data retention; any residual data in backups is not accessible through the Services and is deleted on the backup rotation cycle.

4.7 Data Protection Impact Assessments

Because our Services involve systematic processing of precise geolocation data — including data associated with minors — Jussive conducts formal Data Protection Impact Assessments and Data Protection Assessments as required by GDPR Article 35, Colorado Revised Statutes § 6-1-1309, and analogous laws in other jurisdictions.

5. Legal Bases for Processing (GDPR / UK GDPR)

If you are located in the European Economic Area ("EEA"), the United Kingdom ("UK"), or Switzerland, Jussive LLC acts as a "controller" of your personal data as defined under the EU General Data Protection Regulation (Regulation (EU) 2016/679) ("GDPR") and the UK GDPR as incorporated by the Data Protection Act 2018. We process personal data only where we have a valid legal basis to do so. The legal basis we rely on depends on the specific purpose for which we process your personal data:

5.1 Performance of a Contract (GDPR Art. 6(1)(b))

We process personal data where necessary to perform the contract we have with you (the Terms of Service) or to take steps at your request before entering into such a contract. This includes:

  • Creating and managing your account;
  • Delivering the Services you have subscribed to, including displaying location, trip, and contact information through the Jussive application and dashboard;
  • Processing subscription payments and renewals;
  • Providing customer support related to your account.

5.2 Consent (GDPR Art. 6(1)(a) and Art. 9(2)(a))

We rely on consent where required by law, in particular:

  • For the collection of location data, contact lists, and other data from a monitored device, which consent is granted through on-device prompts;
  • For the processing of data associated with a child, where a parent or legal guardian provides verifiable consent;
  • For optional marketing communications;
  • For non-essential cookies and similar tracking technologies on our website.

You have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. To withdraw consent, disable the relevant permission on the device, adjust your cookie preferences, or contact support@jussive.com.

5.3 Legitimate Interests (GDPR Art. 6(1)(f))

We process personal data where necessary for our legitimate interests or those of a third party, provided these interests are not overridden by your rights and freedoms. Our legitimate interests include:

  • Securing our Services and preventing fraud, abuse, and AUP violations;
  • Diagnosing technical problems and improving the reliability and functionality of the Services;
  • Understanding how our Services are used so we can improve them;
  • Defending or bringing legal claims;
  • Conducting limited business communications with existing Subscribers about the Services.

You have the right to object to processing based on legitimate interests. See Section 13 (Your Rights).

5.4 Legal Obligation (GDPR Art. 6(1)(c))

We process personal data where necessary to comply with our legal obligations, including tax and accounting laws, anti-money-laundering laws, responses to lawful requests from public authorities, and cooperation with supervisory authorities.

5.5 Vital Interests (GDPR Art. 6(1)(d))

In rare cases, we may process personal data to protect the vital interests of a data subject or another natural person — for example, in response to a safety-of-life emergency involving a monitored user.

5.6 Data Controller and Data Processor Roles

Jussive acts as the data controller for personal data relating to Subscribers (account holders). With respect to data collected from Monitored Devices, the Subscriber who enrolled the device is typically the controller (or joint controller) of that data, and Jussive acts as a data processor providing the Services on the Subscriber's behalf. In such cases, the Subscriber is responsible for establishing the lawful basis for the processing and for obtaining any necessary consents, including from monitored adults and, where applicable, parental consent for minors.

You may contact our privacy team at support@jussive.com with any questions about this Policy or our processing of your personal data.

5.8 Right to Lodge a Complaint

If you are in the EEA, UK, or Switzerland, you have the right to lodge a complaint with your local data protection supervisory authority. A list of EEA supervisory authorities is available at https://edpb.europa.eu/about-edpb/board/members_en. UK residents may contact the Information Commissioner's Office (ICO) at https://ico.org.uk. Swiss residents may contact the Federal Data Protection and Information Commissioner (FDPIC) at https://www.edoeb.admin.ch. We would, however, appreciate the opportunity to address your concerns before you approach a regulator, so please contact us first at support@jussive.com.

6. Children's Data (COPPA and Similar Laws)

Jussive is designed to allow parents/legal guardians to monitor devices used by their children with consent appropriate to the child's age and applicable law.

  • Parents/guardians warrant they have legal authority to consent to collection from a device used by their child;
  • We do not knowingly collect data directly from children under 13 without verifiable parental consent;
  • Parents may review, delete, or refuse further collection by contacting support@jussive.com;
  • Report suspected COPPA violations to us immediately.

7. How We Share Information

  • Service providers and subprocessors (hosting, payments, email delivery, app distribution) — see Section 8 for a current list;
  • Legal compliance — subpoenas, court orders, lawful requests, or to protect rights/safety;
  • Business transfers — mergers, acquisitions, asset sales (with notice);
  • With your direction — when you expressly consent.

We do not sell personal information. We do not share for cross-context behavioral advertising.

8. Subprocessors

Jussive engages a limited set of carefully selected third-party service providers ("subprocessors") to help deliver the Services. The current list of subprocessors is:

  • Amazon Web Services, Inc. (AWS) — cloud infrastructure hosting, storage, and compute (region: US-East / N. Virginia). Processes: all categories of personal data described in Section 2. Location: United States.
  • Amazon Web Services, Inc. (AWS SES) — transactional email delivery (region: US-East). Processes: email addresses and email content (account notifications, receipts, support communications). Location: United States.
  • Google LLC (Google Workspace / Gmail) — business email delivery and correspondence. Processes: email addresses and email content. Location: United States.
  • Stripe, Inc. — payment processing, subscription management, and fraud prevention. Processes: name, email, billing address, payment card tokens, transaction history. Location: United States. (Jussive does not receive or store full payment card numbers.)
  • Apple Inc. — distribution of the Jussive iOS application via the Apple App Store and processing of in-app purchases where applicable. Processes: Apple ID identifiers, device identifiers, purchase records. Location: United States (with regional infrastructure).
  • Google LLC (Google Play) — distribution of the Jussive Android application via the Google Play Store and processing of in-app purchases where applicable. Processes: Google account identifiers, device identifiers, purchase records. Location: United States (with regional infrastructure).

We will update this list as our subprocessors change. Subscribers with an active account may request advance notice of material changes to our subprocessor list by emailing support@jussive.com.

9. Data Retention

  • Location / trip data: rolling 7 (basic) to 90 days dependent upon subscription;
  • Device contacts: duration of active subscription;
  • Account information: duration of Account plus reasonable post-termination period;
  • Billing records: as required by law (typically 7 years);
  • Backups: may briefly persist after deletion.

10. Security

We use administrative, technical, and physical safeguards including encryption in transit, access controls, and audit logging. No system is perfectly secure.

11. International Data Transfers

Jussive is headquartered in the United States, and all of our production infrastructure and subprocessors listed in Section 8 are located in or primarily operate from the United States. Accordingly, if you access the Services from outside the United States — including from the European Economic Area ("EEA"), the United Kingdom ("UK"), or Switzerland — your personal data will be transferred to, stored in, and processed in the United States and potentially other jurisdictions where our subprocessors operate.

11.1 Nature of the Transfer

The United States has not received a general adequacy decision from the UK government under UK GDPR Article 45 or from the Swiss Federal Data Protection and Information Commissioner. The EU has adopted an adequacy decision covering certain U.S. recipients certified under the EU-U.S. Data Privacy Framework ("DPF"), and the UK has adopted the UK Extension to the DPF. Where our U.S. subprocessors are certified under the DPF, we rely on that certification as an additional transfer mechanism.

11.2 Transfer Mechanisms

Where we transfer personal data outside the EEA, UK, or Switzerland to a country that has not received an adequacy decision, we implement one or more of the following safeguards as required by GDPR Chapter V and UK GDPR:

  • Standard Contractual Clauses ("SCCs") adopted by the European Commission (Commission Implementing Decision (EU) 2021/914);
  • The UK International Data Transfer Agreement ("IDTA") or the UK Addendum to the EU SCCs issued by the Information Commissioner's Office;
  • The Swiss Addendum to the EU SCCs, where applicable;
  • Reliance on the EU-U.S. Data Privacy Framework, the UK Extension to the DPF, and the Swiss-U.S. DPF where the receiving subprocessor is certified;
  • Supplementary technical measures, including encryption in transit (TLS 1.2+) and at rest (AES-256), access controls, and audit logging.

11.3 Transfer Impact Assessment

Consistent with the CJEU's judgment in Schrems II (Case C-311/18) and guidance from the European Data Protection Board and the UK ICO, Jussive has conducted transfer impact assessments for transfers of personal data to the United States. These assessments consider the laws of the destination country, the nature of the data transferred, and the supplementary measures applied.

11.4 Your Rights Regarding Transfers

You may request a copy of the relevant transfer mechanism (e.g., executed SCCs, with commercial terms redacted) by contacting support@jussive.com. If you do not wish your personal data to be transferred to the United States, you should not use the Services, as U.S. processing is integral to the operation of the Services.

13.1 California (CCPA/CPRA)

End User License Agreement

This EULA governs your use of the Jussive mobile application (the "App"). By installing or using the App, you agree to this EULA, the Terms of Service, Privacy Policy, and Acceptable Use Policy.

1. License Grant

Subject to compliance with this EULA, Jussive LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App on devices you own or control, solely for personal or internal household use.

2. Restrictions

You shall not, and shall not permit any third party to:

  • Reverse engineer, decompile, disassemble, or derive source code, underlying ideas, algorithms, file formats, or non-public APIs of the App, except to the extent expressly permitted by law notwithstanding this restriction;
  • Copy, modify, adapt, translate, or create derivative works of the App;
  • Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or commercially exploit the App;
  • Remove, alter, or obscure any proprietary notices;
  • Use the App to build a competitive product or for benchmarking without written consent;
  • Circumvent, disable, or interfere with security, authentication, or access-control features;
  • Use automated means (bots, scrapers, crawlers) to access the App;
  • Introduce viruses, malware, or harmful code;
  • Transmit unlawful, harassing, defamatory, or infringing content;
  • Attempt to gain unauthorized access to the App, servers, networks, or other Accounts;
  • Violate applicable export, sanctions, or import laws;
  • Use the App in a manner that violates the AUP, Terms of Service, or law.

3. Consent Requirement

The App requires consent from the user of the device on which it is installed. By installing on a device used by another person, you represent you have legal authority and have obtained all necessary consents.

4. Ownership

The App is licensed, not sold. Jussive and its licensors retain all right, title, and interest, including IP rights.

5. Updates

Jussive may deliver updates, upgrades, patches, or modifications. This EULA applies to all such updates unless accompanied by a separate license.

6. Third-Party Components

The App may include third-party software subject to their own licenses.

7. Apple App Store Terms

If obtained from the Apple App Store:

  • This EULA is between you and Jussive only; Apple is not a party;
  • License is limited to use on Apple-branded products you own or control;
  • Jussive, not Apple, is solely responsible for the App;
  • Apple has no obligation to provide maintenance or support;
  • If the App fails to conform to warranty, you may notify Apple; Apple will refund the purchase price; Apple has no other warranty obligation;
  • Jussive, not Apple, is responsible for product claims;
  • Jussive is responsible for third-party IP infringement claims;
  • You represent you are not in a U.S.-embargoed country and not on a restricted-party list;
  • Apple and its subsidiaries are third-party beneficiaries and may enforce this EULA.

8. Google Play

If obtained via Google Play, Google's terms apply to distribution and billing. Google is not a party to this EULA.

9. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, as set forth in the Service Disclaimer embedded in the Terms of Service.

10. Limitation of Liability

Liability is limited as set forth in the Terms of Service.

11. Termination

Effective until terminated. Terminates automatically upon your breach. You may terminate by uninstalling. Upon termination you must delete all copies.

12. Governing Law

Governed by the laws of South Carolina, consistent with the Terms of Service. Apple-specific provisions governed consistent with Apple requirements.

This Acceptable Use Policy ("AUP") governs your use of the Jussive Services and is incorporated into the Terms of Service, EULA, and Privacy Policy. By registering for an Account, you expressly accept this AUP.

1. Purpose

Jussive provides monitoring tools for lawful, consent-based use, primarily parental and household oversight. Violations may result in immediate suspension or termination without refund, and we may report unlawful activity to law enforcement.

2. Permitted Uses

You may use the Services to:

  • Monitor devices you lawfully own and use yourself;
  • Monitor devices used by your minor children for whom you have legal authority, consistent with applicable law;
  • Monitor devices of household members with their informed, ongoing, revocable consent;
  • Monitor employee devices only where permitted by law, disclosed in writing, and authorized by a written workplace policy.

3. Prohibited Uses

You must not use the Services to:

3.1 Unlawful Surveillance

  • Monitor any adult without informed, ongoing consent (stalkerware use);
  • Monitor a current or former romantic partner, spouse, or ex-spouse without informed consent;
  • Violate wiretapping, eavesdropping, surveillance, privacy, or anti-stalking laws;
  • Violate a restraining order, protective order, or court order;
  • Record or intercept communications in violation of two-party consent laws.

3.2 Harassment and Harm

  • Harass, stalk, threaten, intimidate, defame, or harm any person;
  • Facilitate domestic abuse, coercion, or control;
  • Engage in human trafficking or similar offenses.

3.3 Unauthorized Access

  • Enroll any device without legal authority;
  • Access any account, device, or data without authorization;
  • Circumvent security, authentication, or consent mechanisms.

3.4 Technical Misuse

  • Reverse engineer, decompile, disassemble, or attempt to extract source code, algorithms, APIs, or protocols (except to the extent expressly permitted by law that cannot be waived);
  • Probe, scan, or test vulnerabilities without written consent;
  • Interfere with, disrupt, overload, or attack the Services (DDoS, floods, injection, exploits);
  • Introduce malware, ransomware, spyware, viruses, worms, Trojans;
  • Use bots, scrapers, crawlers, or other automated tools;
  • Bypass rate limits, authentication, or subscription restrictions;
  • Access via unauthorized clients, emulators, or modified apps;
  • Create derivative works, competing services, or benchmarks without consent;
  • Resell, sublicense, white-label, or redistribute without a written agreement.

3.5 Fraud and Deception

  • Provide false registration information;
  • Use fraudulent, stolen, or unauthorized payment methods;
  • Initiate chargebacks without first contacting support;
  • Create multiple accounts to evade limits, suspensions, or bans;
  • Misrepresent identity or authority to monitor.

3.6 Content and Legal Violations

  • Submit illegal, infringing, obscene, or harmful-to-minors content;
  • Violate IP, publicity, or privacy rights;
  • Violate export controls, sanctions, or anti-terrorism laws;
  • Use the Services where prohibited.

3.7 Emergency and Safety-Critical Uses

  • Rely on Services as an emergency response or 911 substitute;
  • Use as the sole safeguard for high-risk activities or critical decisions.

4. Consent Rules

  • Minors: follow age-appropriate disclosure obligations and applicable laws (COPPA, GDPR Article 8, state laws);
  • Adults: require clear, informed, ongoing, revocable consent;
  • Employees: require written disclosure, written policy, and compliance with employment/privacy law;
  • Never use the Services to violate a court order.

5. Security Obligations

  • Keep credentials confidential;
  • Use strong passwords and MFA if available;
  • Promptly notify support@jussive.com of suspected compromise;
  • Do not enable others to violate this AUP.

6. Reporting Violations

Report suspected violations to support@jussive.com. If you believe you are the target of unlawful monitoring through Jussive, contact us immediately. We may cooperate with law enforcement. Victims of domestic violence or stalking: contact local authorities. In the U.S., the National Domestic Violence Hotline is 1-800-799-7233.

7. Enforcement

Jussive may, without notice:

  • Investigate suspected violations;
  • Suspend or terminate Accounts;
  • Remove content;
  • Withhold refunds;
  • Report violations to law enforcement;
  • Pursue legal remedies.

We are not obligated to monitor use but reserve the right to do so.

Jussive LLC ("Jussive," "we," "our," or "us") builds consent-based device monitoring software for families and households. We are not stalkerware. This statement explains our public commitments, the platform policies we comply with, and the resources available to anyone who believes they are being unlawfully monitored.

1. Our Anti-Stalkerware Commitment

Jussive is designed exclusively for lawful, consent-based monitoring, primarily parental and household oversight. We categorically reject use of our Services for stalking, harassment, covert surveillance of adults, intimate partner monitoring without consent, or any form of coercive control.

1.1 What We Will Never Do

  • We will never offer a "hide from app drawer" or "stealth mode" feature that conceals the Jussive application from the user of the device it is installed on;
  • We will never suppress operating system indicators of monitoring in their entirety (such as the iOS location arrow or Android persistent notification);
  • We will never market the Services to catch cheating spouses, surveil adults without their consent, or evade law enforcement;
  • We will never sell monitored-user data to advertisers, data brokers, or any third party;
  • We will never require a manager/account-holder's permission for a monitored user to contact our abuse channel and obtain help.

1.2 What We Will Always Do

  • Display a visible, uniquely labeled Jussive app icon on the device at all times;
  • Show a persistent, non-dismissible notification on Android devices while monitoring is active;
  • Require explicit, on-device consent before any data collection begins;
  • Name the account holder (manager) in disclosures presented to the monitored user;
  • Maintain a functional, responsive abuse channel empowered to disable monitoring unilaterally;
  • Allow the monitored user to uninstall the application at any time on the Basic Subscription;
  • Publish clear documentation of what we collect, how long we keep it, and who can access it.

2. Apple App Store Compliance (Guideline 5.1.2)

Jussive complies with Apple App Store Review Guideline 5.1.2, which governs apps that collect and share user data and apps with monitoring functionality. Our compliance includes:

  • Honest and accurate App Store listing that clearly describes the monitoring purpose of the application;
  • Clear, explicit onboarding consent flow presented on every monitored device before any data collection begins;
  • Respect for iOS privacy indicators, including the persistent location-in-use arrow, the green camera dot, and the orange microphone dot — none of which we attempt to suppress, mask, or work around;
  • Use of standard iOS frameworks (Core Location, Contacts, etc.) with the least permissions necessary;
  • Privacy Nutrition Labels that accurately disclose all data categories collected;
  • No use of private APIs, entitlement workarounds, or jailbreak-dependent functionality;
  • Integration with Apple Family Sharing and Screen Time where applicable, rather than duplicating or undermining Apple's native child-safety tools.

3. Google Play Compliance (Stalkerware Policy)

Jussive complies with Google Play's policy governing monitoring, tracking, and spying apps (commonly referred to as the "Stalkerware policy"), first published in September 2020 and updated periodically. Our compliance includes:

  • Exclusive design and marketing for parental monitoring and household oversight — no marketing or functionality aimed at covert adult surveillance;
  • A persistent, user-visible notification shown in the Android notification shade at all times while monitoring is active;
  • A unique, clearly identifiable Jussive app icon shown on the home screen and in the app drawer — never hidden, disguised, renamed to a system service, or cloaked;
  • Accurate Google Play Store listing and metadata that honestly describe the monitoring purpose;
  • No mechanism by which an account holder can hide the application from the user of the monitored device;
  • Transparent disclosure at install time of all data the application will collect;
  • A functional consent-revocation and uninstall path available to the monitored user at all times on the Basic Subscription.

4. On-Device Disclosures

Every device enrolled under a Jussive account displays the following disclosures to the user of that device:

4.1 At Install / Enrollment

  • A full-screen consent flow identifying Jussive by name;
  • The email address of the account holder (manager) who will receive the monitored data;
  • A plain-language description of every category of data collected;
  • The retention period for each category of data;
  • Instructions for revoking consent and uninstalling the application;
  • The abuse-channel contact address (support@jussive.com) with a statement that it can be used independently of the account holder.

4.2 Persistent On-Device Indicators

  • A uniquely labeled "Jussive" app icon visible on the home screen and in the app drawer;
  • On Android: a persistent, non-dismissible notification in the notification shade whenever monitoring is active;
  • On iOS: standard OS-level indicators (location arrow) are never suppressed;
  • An "About this monitoring" screen accessible from the Jussive app icon at any time, summarizing who is monitoring, what is collected, and how to get help.

5. Abuse Channel & Independent Revocation

We maintain an independent abuse channel at support@jussive.com for anyone who believes they are being unlawfully monitored, was enrolled without consent, is the subject of coercive or abusive monitoring, or otherwise needs Jussive to intervene.

5.1 Our Commitments

  • Initial response is provided within seven (7) business days, with expedited response for credible safety concerns;
  • Jussive has the authority and the technical means to disable monitoring on a specific device without the account holder's approval where circumstances warrant;
  • We will not notify the account holder that an abuse report has been filed when doing so would endanger the reporter;
  • We cooperate with law enforcement upon valid legal process, and we publish our guidelines for government requests.

5.2 How to Contact Us

If you believe you are being unlawfully monitored through Jussive, or if you installed Jussive and want to remove it but cannot, contact us immediately:

6.5 How to Check Your Device

The following steps can help you identify whether monitoring software — Jussive or otherwise — may be installed on your device. If you believe you are in a dangerous situation, consult a domestic violence advocate before making changes, as sudden removal may alert the person monitoring you.

  • Review your home screen and app drawer for unfamiliar applications, including those with generic names ("System Service," "Battery Optimizer," etc.).
  • On Android: Settings → Apps → review all installed applications. On iOS: Settings → General → iPhone Storage → review all applications.
  • Check for unusual battery drain or data usage, which can indicate background monitoring.
  • Review which applications have access to Location, Contacts, Microphone, and Camera.

This Parental Consent Notice explains how Jussive LLC ("Jussive," "we," "our," or "us") complies with the U.S. Children's Online Privacy Protection Act ("COPPA") and analogous laws when a parent or legal guardian enrolls a device used by a child under the age of 13. 2. When This Notice Applies

This Notice applies whenever a parent or legal guardian enrolls, under a Jussive account, a device used by a child under the age of 13 residing in the United States. Analogous procedures are followed for children under the applicable age of digital consent in other jurisdictions (for example, age 13–16 under GDPR Article 8, depending on EU member state).

3. Information We Collect From a Child's Device

With verifiable parental consent, Jussive may collect the following categories of information from a device enrolled by a parent and used by a child under 13:

  • Precise geolocation data, including GPS coordinates, visited places, trip routes, and timestamps;
  • Telemetry data such as speed during recorded trips, where supported by the device;
  • Device contact information stored on the device (name, phone number, email), up to 1,000 contacts per device on the Basic Subscription;
  • Device metadata (model, operating system version, application version, enrollment identifiers);
  • Diagnostic and crash data necessary to operate and secure the Services.

We do not knowingly collect messages, call content, photographs, keystrokes, passwords, or browsing history from a child's device without affirmative action by the account holder and appropriate consent.

4. How We Use a Child's Information

Information collected from a child's device is used solely to:

  • Provide the monitoring functionality selected by the parent or legal guardian;
  • Display information to the parent or legal guardian through the Jussive application and web dashboard;
  • Maintain the security, integrity, and reliability of the Services;
  • Comply with legal obligations.

We do not use a child's information for advertising, profiling, or any purpose not directly related to the parental monitoring service. We do not sell or share children's information.

5. Verifiable Parental Consent

Jussive obtains verifiable parental consent from the account holder before enabling monitoring on any device enrolled for use by a minor child. Consent is obtained at the time of device enrollment — the moment at which the account holder identifies that a device will be used by a minor — using a method designed to satisfy 16 C.F.R. § 312.5.

5.1 When Consent Is Obtained

Consent is obtained at device enrollment, not at subscription purchase. When an account holder initiates enrollment of a new device, Jussive asks the account holder to identify who will use the device. If the account holder identifies the device as being used by a minor child under their legal authority, Jussive presents the Direct Notice and requests affirmative consent before any information is collected from the device. This ensures that consent is tied to the specific device and specific minor for whom monitoring is being authorized, and that the account holder sees the Direct Notice version in effect at the time collection is authorized.

5.2 Repeat Enrollments

Each enrollment of a device for a minor child requires its own affirmative consent event. An account holder who has previously consented with respect to one device does not, by that prior consent, authorize collection from any additional device subsequently enrolled for use by a minor. Each new device enrollment triggers a fresh Direct Notice presentation and a fresh affirmative consent action.

5.3 Verification Method

Jussive uses the online-payment-system method authorized under 16 C.F.R. § 312.5(b)(2)(ii). At the time of consent, the account holder has an active Jussive subscription with a valid payment method processed through our payment provider in the account holder's name. The verification consists of the following elements, taken together:

  • A valid payment method on file with Jussive in the account holder's name, processed through our payment provider and subject to that provider's identity, fraud, and transaction controls;
  • Transaction receipts from our payment provider sent to the account holder's email of record for each subscription charge and renewal, providing the account holder with recurring notification of the payment relationship on which the verification is based;
  • A confirmation email from Jussive sent to the account holder's email of record immediately following the consent event, explicitly identifying the consent that was given, the information to be collected, and contact information for revocation or dispute.

Together, these elements are designed to ensure that the person providing consent is the account holder of record, and to provide the account holder with multiple independent channels through which to detect and contest unauthorized consent.

5.4 Direct Notice Content

At each consent event, the account holder receives, in clear and understandable language:

  • The identity of Jussive as the operator and contact information;
  • The specific categories of information that will be collected from the child's device;
  • The purposes for which each category will be used;
  • Identification of the categories of service providers that may access the information;
  • The retention period for each category;
  • A statement of the account holder's rights to review, delete, and refuse further collection at any time;
  • Instructions for exercising those rights;
  • A link to the Jussive Privacy Policy and this Parental Consent Notice.

5.5 Account Holder's Representations

By providing consent, the account holder affirms that:

  • They are the parent or legal guardian of, or otherwise have lawful authority over, the child who will use the device being enrolled;
  • They have read and understood the Direct Notice and this Parental Consent Notice;
  • They authorize Jussive to collect the categories of information described from the specific device being enrolled and to use them as described;
  • They understand they may review, delete, or refuse further collection at any time through account settings or by contacting support@jussive.com;
  • They will inform the child that the device is monitored, in a manner appropriate to the child's age.

5.6 Record of Consent

Jussive maintains a durable record of each consent event, including:

  • The account holder's identity and account identifier;
  • The date and time of the consent event;
  • The specific version of the Direct Notice presented, identified by document hash;
  • The device identifier for the device being enrolled;
  • The payment method reference from our payment provider that supported the verification;
  • The IP address and user-agent from which the consent was given;
  • The confirmation email delivery record.

Consent records are retained for the duration of the related enrollment and for no less than three (3) years thereafter, or longer if required by applicable law.

5.7 Material Changes to the Direct Notice

If Jussive makes material changes to what information is collected from monitored devices, how it is used, or with whom it is shared, the updated Direct Notice is presented in full to the account holder at the next device enrollment event, and fresh affirmative consent is obtained with respect to the information collected under the updated terms. Account holders are also notified of material changes by email.

5.8 Alternative Verification Method

Account holders who prefer not to rely on payment-based verification — for example, where the account was paid for by a third party such as a gift subscriber, or where the account holder prefers a more formal verification step — may request an alternative verification method, including a signed electronic consent form or other method authorized under 16 C.F.R. § 312.5(b)(2). To request alternative verification, contact support@jussive.com.

5.9 Unauthorized Consent

If an account holder believes that someone has used their account or payment method to grant consent without authorization — for example, a minor child using the account holder's credentials — the account holder should contact Jussive immediately at support@jussive.com. Upon a credible report of unauthorized consent, Jussive will promptly suspend any resulting enrollment, investigate the circumstances, and delete any information collected during the period of unauthorized consent, in addition to taking account security steps with the account holder.

6. Parent's Representations

By providing consent and enrolling a device used by a child under 13, the parent or legal guardian represents and warrants that:

  • They are the parent or legal guardian of the child, or have equivalent legal authority under applicable family or custody law;
  • They have the legal right to consent to the collection, use, and disclosure of the child's information as described in this Notice;
  • They will use the Services solely for lawful parental oversight and not for any purpose that would harm the child or violate any court order, custody agreement, or applicable law;
  • They will inform the child that the device is monitored, in a manner appropriate to the child's age;
  • They will promptly notify Jussive if they cease to have legal authority to enroll the child's device.

7. Parent's Rights

At any time, a parent or legal guardian who has provided consent may:

  • Review the personal information collected from their child;
  • Request deletion of some or all of the child's personal information;
  • Refuse to permit further collection or use of the child's information;
  • Revoke consent and terminate the child's enrollment;
  • Obtain a copy of the child's personal information in a portable format, where technically feasible.

To exercise any of these rights, contact support@jussive.com from the email address on file for the account, or follow the in-application instructions. We will verify the request and respond within the timeframe required by law (generally 30 days under COPPA, shorter under some state laws).

8. Age-Appropriate Disclosure to the Child

Jussive believes that children — even those below the age of legal consent — should understand when their device is being monitored. Accordingly, every enrolled device displays age-appropriate disclosures directly to the user of the device:

  • A visible Jussive application icon labeled in plain language;
  • On Android, a persistent notification indicating that monitoring is active;
  • An "About this monitoring" screen, accessible from the Jussive icon, that identifies the parent or guardian by name or account email and explains in simple language what is collected;
  • A statement that the child may speak with a trusted adult or contact support@jussive.com if something feels wrong.

These disclosures are in addition to, and do not substitute for, the legal consent provided by the parent or guardian.

9. Data Retention for Children's Data

We retain information collected from a child's device only for as long as reasonably necessary to provide the Services and for the purposes for which the information was collected:

  • Location and trip data: rolling seven (7) days on the Basic Subscription or up to plan allowance;
  • Device contact information: for the duration of the active subscription;
  • Account-level records and verifiable-consent records: for the duration of the enrollment and a reasonable period thereafter as required by law;
  • Backup copies: may briefly persist after deletion in the ordinary course of our secure backup procedures.

When a parent revokes consent, terminates enrollment, or requests deletion, we delete the child's personal information promptly, subject to limited exceptions required by law (such as billing records).

10. Disclosure of Children's Information

We do not disclose a child's personal information except:

  • To the parent or legal guardian who provided consent, through the Jussive application and dashboard, which is the primary purpose of the Services;
  • To service providers required to protect the information and use it solely to operate the Services on our behalf (for example, cloud hosting, mapping providers, and communications platforms);
  • As required by law, valid legal process, or to protect the safety of the child or others;
  • In connection with a corporate transaction such as a merger or asset sale, subject to advance notice and equivalent protections in the successor entity.

We do not sell or share children's personal information for advertising, marketing, or any commercial purpose unrelated to the Services.

11. International Equivalents (GDPR Article 8 and Similar Laws)

For children residing outside the United States, we apply equivalent or stronger consent standards based on applicable law:

  • European Economic Area / United Kingdom: verifiable consent from the holder of parental responsibility is required for children below the age of digital consent set by the applicable member state (generally 13 to 16 under GDPR Article 8);
  • California: additional protections apply for minors under 16 under the California Consumer Privacy Act and California Age-Appropriate Design Code Act;
  • Other jurisdictions: we comply with local children's privacy laws and defer to the stricter of U.S. or local requirements.

12. Changes to This Notice

We may update this Notice from time to time. Material changes affecting the collection, use, or disclosure of a child's personal information will not apply retroactively without new verifiable parental consent. We will notify account holders of material changes through the application, by email, or by posting to our website.

This Service Disclaimer ("Disclaimer") is incorporated into and forms part of the Jussive LLC Terms of Service ("Terms"). Capitalized terms not defined here have the meanings given in the Terms. In the event of conflict between this Disclaimer and the Terms, the Terms control.

1. Service Scope

Jussive LLC ("Jussive," "we," "our," or "us"), a limited liability company, offers software-as-a-service ("Services") for device activity monitoring. Current Services focus on parental and household device oversight, and may expand in scope over time.

1.1 Basic Subscription Includes

  • Location capture, including visited places, trip routes, last reported location, and raw GPS points, subject to device capability and user consent;
  • Interactive mapping and visualization;
  • Trip playback with telemetry (e.g., speed), where supported by the device;
  • Storage of up to 1,000 device contacts per enrolled device, where supported;
  • Retention of location and trip data for seven (7) rolling days from the time of capture;
  • Retention of device contacts for the duration of the active subscription.

1.2 Enhanced Plans

Features beyond the Basic Subscription (including but not limited to extended retention, mobile device management, supervisory controls, and consent-lock features) are in development. Availability, pricing, features, and timelines are not guaranteed and are subject to change without notice.

2. Recurring Subscriptions & Billing

2.1 Auto-Renewal

The Basic Subscription and any future paid plans are offered on a recurring basis. Your subscription automatically renews at the end of each billing period at the then-current rate unless canceled before the renewal date.

2.2 Cancellation

You may cancel at any time through your account settings (or, for Apple App Store subscribers, through your Apple ID subscription settings; for Google Play subscribers, through Google Play). Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time except where required by law.

2.3 Billing Processor

Payments may be processed by third parties (e.g., Stripe, Apple, Google). Their terms govern payment processing. Jussive is not responsible for processor errors, chargebacks, or holds.

2.4 Price Changes

We may change subscription prices. Material changes will be communicated at least thirty (30) days in advance (or as required by applicable law), and will take effect on your next renewal.

2.5 Data on Cancellation

Upon cancellation or non-renewal, access to Services and stored data may be terminated after a grace period. You are responsible for exporting data before cancellation.

3. "As Is" Service; No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUSSIVE DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION:

  • Accuracy, completeness, timeliness, or reliability of telemetry, location, or contact data;
  • Uninterrupted, secure, or error-free operation of any Service component, including APIs, servers, databases, or supporting infrastructure;
  • Compatibility with any specific device, operating system, carrier, or third-party service;
  • Resistance of monitored devices to tampering, jailbreaking, rooting, sideloading, or circumvention;
  • Prevention of unauthorized access, malware, or data interception;
  • Merchantability, fitness for a particular purpose, title, and non-infringement;
  • Any specific outcome, including detection of events such as loss, theft, emergencies, endangerment, or unlawful activity.

This list is illustrative and not exhaustive. Jussive disclaims all other warranties of any nature not expressly granted in writing, to the fullest extent permitted by applicable law.

4. Not an Emergency or Safety Service

The Services are informational tools only. They are NOT:

  • An emergency response, 911, or public safety service;
  • A substitute for supervision, caregiving, or professional advice (legal, medical, psychological, security, or otherwise);
  • A guaranteed means of locating or protecting any person or property.

You must not rely on the Services for life-safety, time-critical, or high-stakes decisions without independent verification and additional safeguards.

5. Consent and Lawful Use

5.1 Consent Required

The Services require explicit, informed, and ongoing consent from the user of each monitored device, obtained through the Jussive mobile application. The Services will not function on a device unless and until consent is granted on that device.

5.2 Revocable Consent

The user of a monitored device may revoke consent, uninstall the application, change device settings, or otherwise interrupt monitoring at any time. Jussive does not guarantee detection of, notification of, or prevention of such revocation on the Basic Subscription. Enhanced Plans (when available) may offer supervisory or consent-lock features; these features depend on device capabilities and operating system permissions and are not infallible.

5.3 Your Obligations

You represent, warrant, and agree that:

  • You have the legal right and authority to monitor each device enrolled under your account;
  • You have obtained all required consents (including, where applicable, from parents, legal guardians, employees, or device owners) in compliance with all applicable laws, including privacy, wiretapping, surveillance, employment, consumer protection, and children's privacy laws (such as COPPA, GDPR, CCPA/CPRA, state two-party consent statutes, and analogous laws in your jurisdiction);
  • You will not use the Services for stalking, harassment, intimate partner surveillance, unlawful workplace monitoring, or any other unlawful purpose;
  • You will inform monitored users that the device is monitored, in a manner required by law.

You are solely responsible for your compliance with applicable law. Jussive may suspend or terminate accounts suspected of misuse.

6. Third-Party Dependencies

The Services rely on third parties, including mobile operating systems (iOS, Android), device manufacturers, mobile carriers, mapping and geocoding providers, cloud infrastructure, and payment processors. Jussive is not responsible for failures, outages, policy changes, data practices, or service modifications attributable to such third parties.

7. Limitation of Liability

To the maximum extent permitted by law, Jussive and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation lost profits, lost data, reputational harm, emotional distress, or loss of goodwill, arising out of or related to the Services, even if advised of the possibility of such damages.

7.1 Aggregate Liability Cap

In no event shall Jussive's aggregate liability arising out of or related to the Services exceed the greater of (a) the amounts paid by you to Jussive in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (USD $100).

7.2 Jurisdictional Limitations

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

8. Modifications

Jussive reserves the right to modify the Services, this Disclaimer, and related agreements at any time. Material changes will be communicated through the application, by email, or by posting to our website. Continued use after the effective date constitutes acceptance.
